1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Learning Pathways Preschool and Kindergarten ("Learning Pathways," "we," "us," or "our"). These Terms govern your access to and use of https://www.learningpw.com (the "Website"), including all informational content, downloadable documents, tour scheduling features, and online enrollment forms.

By accessing, browsing, or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Website immediately.

2. Informational Purpose & Educational Services

The Website is provided exclusively to inform parents and guardians about our early childhood educational programs (Preschool, Kindergarten, Pathways to Fitness & Coordination, Pathways to Cooking, Yoga for Children, STEM), tuition schedules, and school operations.

Content on this Website is subject to change without notice. The availability of enrollment spots, tuition rates, and classroom placements are governed solely by official written Enrollment Contracts and Community Care Licensing documentation.

3. Admissions, Applications & Waitlist Policies

  • Application Processing Fee: Submission of an online or paper enrollment application requires a non-refundable $50 application processing fee. Applications will not be processed or placed on our waitlist until this fee is received.
  • First-Come, First-Served Admissions: Applications are evaluated on a first-come, first-served basis, with priority given to returning students, siblings of enrolled students, and full-day program applicants.
  • Advance Tuition Guarantee: Upon acceptance of an enrollment offer, parents must submit a signed Enrollment Contract along with a non-refundable $1,000 advance tuition payment within fifteen (15) days. This payment secures your child's placement and is applied toward the first month's tuition.
  • Age & Potty-Training Prerequisites: Children must meet minimum age standards (2 years 3 months on or before August 15 of the school year) and toilet-training prerequisites outlined in our published school policies.

4. Tuition, Fees & Third-Party Payment Gateways

  • Tuition Due Date & Late Fees: Monthly tuition is due on the first (1st) day of each month. A $100 late fee is assessed if tuition is unpaid by the tenth (10th) of the month. Accounts remaining unpaid on the fifteenth (15th) will result in enrollment suspension.
  • Non-Refundable Payments: Tuition payments and advance tuition deposits are strictly non-refundable, except where enrollment is terminated directly by Learning Pathways. No refunds or credits are issued for mid-month withdrawals.
  • Withdrawal Notice: A minimum of thirty (30) days advance written notice via our official Withdrawal Form is required to withdraw a student.
  • Third-Party Payment Gateways: Automated electronic tuition payments are facilitated via Procare Software LLC and Tuition Express. You agree that your transactions through third-party billing portals are subject to the terms and privacy notices of those respective service providers. Learning Pathways is not liable for third-party billing errors, gateway outages, or banking transmission delays.

5. Intellectual Property Rights

All text, graphics, logos, curriculum materials, proprietary program names (including "Pathways to Fitness and Coordination" and "Pathways to Cooking"), page layouts, and software on this Website are the exclusive property of Learning Pathways or its content licensors and are protected under United States and international copyright, trademark, and unfair competition laws.

You may view, print, or download informational materials (such as the Parent Handbook) solely for personal, non-commercial use regarding your family's enrollment.

6. Classroom & Student Photographs

All photographs and videos published on the Website depict actual Learning Pathways students, faculty, and classroom environments and are published with parental media authorization in accordance with California childcare licensing standards. You are strictly prohibited from copying, capturing, downloading, or redistributing any student photographs or videos for any purpose.

7. Prohibited User Conduct

When using the Website, you agree not to:

  • Transmit any unlawful, fraudulent, defamatory, or harmful content.
  • Interfere with or disrupt the operation, security, or networks of our web servers.
  • Use any automated robot, spider, scraper, or data-mining tool to extract content from the Website.
  • Attempt to gain unauthorized access to any administrative, server, or database systems.

8. Disclaimer of Warranties

THE WEBSITE AND ALL MATERIALS, FORMS, AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LEARNING PATHWAYS DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER CALIFORNIA LAW, IN NO EVENT SHALL LEARNING PATHWAYS PRESCHOOL AND KINDERGARTEN, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE, FORMS, OR DOWNLOADABLE DOCUMENTS. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD) OR THE AMOUNT OF THE APPLICATION FEE PAID, WHICHEVER IS LESS.

  • Governing Law: These Terms and any dispute arising from your use of the Website shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
  • Binding Arbitration: Any controversy, dispute, or claim arising out of or relating to these Terms or the Website shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) or JAMS in Santa Clara County, California, before a single neutral arbitrator.
  • Class Action Waiver: YOU AND LEARNING PATHWAYS AGREE THAT ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

11. Modifications to Terms

We reserve the right to revise these Terms at any time. Updated versions will be posted to the Website with a revised "Last Updated" date. Continued use of the Website after modifications constitutes your agreement to the updated Terms.
